This paperback examines the exceptional constitutional history of Czechoslovak territory between 1918 and 1945, when extraordinary measures became the rule and lawmaking powers shifted from parliament to the government. The authors present delegated lawmaking as a legal and political mechanism and argue that behind extraordinary legal instruments there was often a process of normalizing the exception, which could gradually transform democracy into autocracy or totalitarianism. Although the government continued to rely on the law, it no longer relied on parliament. The experience of Czechs and Slovaks, especially between 1938 and 1945, shows the political and legal risks of excessively using and abusing the delegation of legislative power to the highest executive authority. In a broader European context, the authors trace how this lawmaking model became established in the modern history of constitutionalism and how it can still serve as a warning against quick solutions that undermine the balance between freedom and unlimited power.
