This monograph examines the part of criminal proceedings in which a court decides on the injured partys private-law claims arising in connection with a criminal offence. Adhesion proceedings allow the injured party to avoid civil proceedings that are more demanding in terms of time, cost and procedure. The institute raises a number of specific questions because the criminal court decides on private-law claims under non-criminal substantive legislation, particularly civil law, while using the procedural form of criminal proceedings. The first part describes, analyses and evaluates adhesion proceedings under the Code of Criminal Procedure, including the parties, subject matter and course of the proceedings, remedies and special forms of procedure such as proceedings before a single judge and proceedings concerning a plea bargain. The next two parts address the injured party and adhesion proceedings under German and Swiss law, explaining the injured partys procedural rights in criminal proceedings and the course of adhesion proceedings. Based on an analysis of the applicable law and a comparison with foreign models, the conclusion presents proposals for future legislation that may be used in the planned recodification of Czech criminal procedural law.
